3)Qays Ibn Fahd who said: “The Prophet (Sallallahu Alaihi wa Sallam) saw me praying two Raka’a after Fajr prayer, he asked: “What are these two Raka’a, Oh Qays ?” I said: ‘Oh, Prophet (Sallallahu Alaihi wa Sallam) of Allah I hadn’t prayed the two Sunnah Fajr Raka’a and these are them'” [Jami’ Tirmidhi:422, Ahmed : 23821][ Ahmad, Abu Dawood and al-Tirmizi ]. * Since the Prophet (Sallallahu Alaihi wa Sallam) did not comment on this, it becomes lawful to do so when there is a necessity. The Prophet (Sallallahu Alaihi wa Sallam) also said in another Hadith:
“Whoever misses to pray the two Fajr Sunnah Raka’a prays them after sunrise” [ al-Tirmizi ].
