& Also Sheikh. Utymeen Said : Speaking about the people of innovation and those who carry unsound concepts or a methodology which is not upright, (then) this is from advice, and Not backbiting.
Rather it is (an act of) sincerity to Allaah, His Book and His Messenger (by carrying out what is commanded and forbidding evil etc) and it is (act of sincerity) to the muslims (by giving them good advice).
So if we see an innovator spreading his innovation then it is obligatory that we make clear that he is an innovator so that the people are saved from his evil.
(Likewise) If we see an individual who has an ideology/concept opposing that which the Salaf were upon, then it is obligatory for us to clarify that so that people are not deceived by him.(Likewise) If we see a person who has a specific methodology (whose) outcome is evil then it is obligatory for us to clarify that so that the people are saved from his evil, and this (done) out of sincerity to Allaah, His Messenger and His Book; and it is sincerity to the rulers and their subjects (by giving good advice so that they saved from evil etc).
Regardless of whether speaking about the people of innovation is (done) amongst students (of knowledge) or in other gatherings, this is not backbiting.
And as long as we fear the spread of these innovations, or that concept or that methodology which is in opposition to the methodology of the Salaf; it is obligatory that we clarify so the people are not deceived by that.

So Refutation can be as a Naseehat to the Soo Called Individulas in today Generations .. save others from misguidance of that deviant individulas As we seen today …
There fore “There is no backbiting with regard to (talking about) the innovator or the sinner who openly professes his evil.
Daleel : IT was Narrated that Affan bin Muslim said ” We were with Ismail bin Ulayyah A Man Narrated a Report from Another Man.. I SAID THAT THIS ONE IS NOT RELIABLE.. The Man Said you BACK BITTING About him . Ismail said ” He is not back bitting Rather he judged that he not Reliable {Sahih Muslim, Mukdima, Hadith No.84 }
Imam Muslim Said :: chapter 5 ; Clarifiction that the chain of naration is the part if Religion , and the reports sholud be only be narrated from those who are trustworthy and that critical Asessment and the evaluation of narrators for things that are true is perssible and is in face ” OBLIGATORY. and that doing so is not BICK Bitting that is forbidden Rather it is Defending the Honaroble sharia…..
See Some narrations from our salaf and also todays Sheiks Fatwas
“You will see from statements mentioned below that our salaf held it to be permissible to backbite an individual in certain situations in accordance to Religion …..
So here we are, the 14 narrations:
1. Al-A’amash reported that Ibraaheem (An-Nakha’ee) said: “There is no backbiting with regard to (talking about) the innovator.” [Al-Laalikaa’ee (1/140, no: 276)]
2. Al-Hasan Al-Basree said: “There is no backbiting with regard to (talking about) the innovator or the sinner who openly professes his evil.” [Al-Laalikaa’ee (1/140, no: 279)]
3. And he also said: “There is no backbiting when it concerns the people of innovations.” [Al-Laalikaa’ee (1/140, no: 280)]
4. Al-Fudayl Ibn ‘Iyyaad said: “Whoever enters upon a person of innovation, then he has no sanctity (i.e. protection from being talked about).” [Al-Laalikaa’ee (1/140, no: 282) ]
5. Sufyaan Ibn ‘Uyainah said: “Shu’abah used to say: ‘Come let us backbite for the sake of Allaah, ‘azza wa jall.’” [Al-Kifaayah fee ‘Ilm-ir-Riwaayah of al-Khateeb Al-Baghdaadee (91) and Sharh ‘Ilal At-Tirmidhee of Ibn Rajab (1/349)]
6. Abu Zayd Al-Ansaaree An-Nahwee said: “Shu’abah came to us on a rainy day and said: ‘This is not a day for (learning) hadeeth. Today is a day for backbiting. Come let us backbite the liars (in hadeeth).’” [Al-Kifaayah fee ‘Ilm-ir-Riwaayah of al-Khateeb Al-Baghdaadee (91)]
7. On the authority of Makkee Ibn Ibraaheem who said: “Shu’abah used to go to ‘Imraan Ibn Hudayr saying (to him): ‘O ‘Imraan, come let us backbite for an hour for the sake of Allaah.’ And they would mention the faults and defects of hadeeth reporters.” [Al-Kifaayah fee ‘Ilm-ir-Riwaayah of al-Khateeb Al-Baghdaadee (91)]
8. Abu Zur’ah Ad-Dimashqee said: “I heard Abu Mushar being asked about a man that makes mistakes, misconstrues and distorts ahaadeeth, so he said: ‘Make his affair known.’ So I said to Abu Zur’ah: ‘Do you consider that to be backbiting?’ He said: ‘No.’”[Sharh ‘Ilal At-Tirmidhee of Ibn Rajab (1/349) and Al-Kifaayah of Al-Baghdaadee (91-92) but there occurs in Al-Khateeb’s report: “So I said to Abu Mushar” instead of “So I said to Abu Zur’ah.”]
9. ‘Abdullah Ibn Al-Mubaarak said: “Al-Mi’allaa Ibn Hilaal is fine except when it comes to hadeeth, he lies.” So someone among the sufis (i.e. ascetics) said: “O Abu ‘Abdir-Rahmaan! Are you backbiting?” So he said: “Be quiet! If we do not clarify this, how will the truth be made known from the falsehood?” [Sharh ‘Ilal At-Tirmidhee of Ibn Rajab (1/349) and Al-Kifaayah of Al-Baghdaadee (91-92) ]
10. ‘Abdullaah, the son of Imaam Ahmad said: “Abu Turaab An-Nakhshabee once went to my father, so my father began saying ‘this person is weak’ and ‘that person is reliable.’ So Abu Turaab said: ‘O Shaikh, do not backbite the scholars!’ So my father turned to him and said: ‘Woe be to you! This is advice, this is not backbiting.”[Al-Kifaayah fee ‘Ilm-ir-Riwaayah of al-Khateeb Al-Baghdaadee (92) and Sharh ‘Ilal At-Tirmidhee of Ibn Rajab (1/350)]
11. Muhammad Ibn Bindaar As-Sabbaak Al-Jarjaanee said: “I once said to Ahmad Ibn Hanbal: ‘Verily, it is becoming hard upon me to say: (So and so is weak) and (so and so is a liar). So Ahmad said: ‘If you remain silent and I remain silent, then who will make the ignorant person aware of the authentic from the defective?’”[Majmoo’-ul-Fataawaa of Ibn Taimiyyah (28/231)]
12. Shaudhab reported that Katheer Abu Sahl said: “It used to be said: ‘The people of desires do not have any sanctity (i.e. protection from being talked about).” [Al-Laalilkaa’ee (1/140, no: 281)]
13. Al-Hasan Ibn ‘Alee Al-Iskaafee said: “I asked Abu ‘Abdillaah Ahmad Ibn Hanbal about the meaning of backbiting. He responded: “It is when you mention the defect of a person.”I said: “What if the person says: ‘Do not hear (hadeeth) from so and so’ and ‘Such and such person makes mistakes (in his narration)?’” He said: “If the people were to abandon doing this, the authentic would not be known from its opposite.” [Sharh ‘Ilal At-Tirmidhee (1/350-351)]
14. Isma’eel Al-Khatabee said: ‘Abdullaah Ibn Ahmad reported to us, saying: “I said to my father: ‘What do you say about seekers of Hadeeth going to a teacher who perhaps is murji’ee or a shi’ee or he has some opposition to the Sunnah in him. Is it permitted for me to remain silent about him or should I warn against him?’ So my father said: ‘If he calls the people to innovation and he is an Imaam (or a head figure) in that and calls to that, then yes, warn against him.’” [Al-Kifaayah (93) and Sharh ‘Ilal At-Tirmidhee (1/350) ]

–>> 1 . The following question was posed to Shaykh Saalih b. Fawzaan Al-Fawzaan – may Allah preserve and protect him (“Sahab Salafi Network” 2012): I intend to write about some deviated groups and warn against them. However, these groups have not left the fold of Islam, and some scholars have praised them, and I fear that [such scholars] might call against me. What is your advice and guidance for me, knowing that this group is deviated?
The Shaykh replied:
Your duty (waajib) is to clarify the truth; your duty is to clarify the truth. If you are sure about their errors and their deviation, you are one hundred percent sure, and you have the ability and the knowledge to explain, then it is a duty upon you to do this.
And when Allah took the covenant from those who were given the scripture that you must explain it to people and not hide it…
(Translation of the meaning of Al-‘Imran: 187)
Verily those who hide the clear guidance that We have revealed…
(Translation of the meaning of Al-Baqarah: 159, 174)
It is not allowed to hide knowledge. If you know and are sure about the deviation of some groups or sects, then clarify them and explain them for the people, so that they may be on guard against them. This is part of naseehah (sincere concern for others; advice).
The Messenger – Allah’s praise and peace be upon him – said:
The religion is naseehah (sincerity).
We asked: “to whom?”
He replied,
“To Allah, and to His Book, and to His Messenger, and to the leaders of the Muslims and their masses.
(Saheeh Muslim, Hadeeth #55)
[In doing so,] do not fear the people. You must fear Allah – the exalted and perfect – and explain the truth and refute falsehood, and not fear people, yes.

2 . Shaykh Ahmad An-Najmee (rahimahullah): The reality is that the people differ and that is no doubt. However, in most cases the affair is that every individual who conceals (an evil) secret (of being upon misguidance), then it is a must that Allah exposes it, (either) upon the glimpses of his face and/or the slips of his tongue. As for the one who displays to the people that he is upon the Sunnah and Salafiyyah while at the same time he is a person of innovation, it is a must that Allah exposes him no matter how long he remains hidden (amongst the people of Salafiyyah). It is a must that there comes from him something which indicates and directs to that which is with him of innovation. The refuge is with Allah. Therefore, when something appears from him of innovation it is a must that he is warned from. As for the case when nothing appears from him then there is no might or power except with Allah.

3 . Clarification the statement of Shaykh Rabee bin Hadee (Fataawa Ash-Shaykh Rabee’ 1/246):
…Al-Jarh Wa At-Tadeel will remain until the day of judgement. The people want to benefit from this particular scholar and you inform them that this person is a noble scholar and upon the Sunnah so you praise him, and this scholar is Raafidee, this one is a Soofee who believes in Wahdatul Wujood (This is referring to the false belief that all in existence is a single reality and that everything we see is only aspects of the essence of Allah), this one is a secularist, this one is a communist who conceals his reality with Islam. This one is this and this one is that. It is obligatory upon you to clarify this; this is an obligation. This is a form of Jihaad and it will not cease and it is not specific to narrators.
Also the Salaf wrote [books] refuting the people of innovation as we have stated and they did not declare Al-Jarh Wa At-Ta’deel to be specific to the narrators alone. He is an innovator and is not from the people of hadeeth, [he is] Mu’tazilee, [he is] Jahmee, [he is] Murjee and so and so forth. He has no connection to any narrations but he is an innovator therefore they criticized him (Al-Jarh). So how can these people claim that the door of Al-Jarh is closed?
In another place the Shaykh said (Fataawa Ash-Shaykh Rabee’ 1/249):
The methodology of Al-Jarh Wa At-Ta’deel will not cease until the day of judgement as long as innovations are present….
